Terms of Service

1. Eligibility and accounts

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create a Hisani account. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for activity that occurs under your account.

Hisani uses a single-account model: one Horseman identity carries your profile, authentication methods, My Horses records, saved and assigned races, Marketplace activity, and other private Product data across the Service. You must not create or use an account on behalf of another person without lawful authority.

2. Description of the Service

The current Service includes account and identity management, My Horses for a private convenience list, Stopwatch for manual sectional timing, Planner for discovering, assigning, and exporting racing condition-book data, Marketplace for creating listings and communicating about them, Dashboard navigation, and authorized Admin operations. A My Horses record is not proof of legal title, registration, eligibility, or health. Stable management is not part of the current Service. We may add, change, or remove features over time.

3. Fees

Hisani does not currently charge through the Service or gate current functionality by a paid subscription or tier. If we later introduce paid functionality, we will present updated commercial terms before payment is required.

4. Acceptable use

You agree not to:

• provide false or misleading information about yourself, a listing, a race, or other content submitted through the Service;
• access or attempt to access another user's account, private messages, saved data, or administrative functions without permission;
• use the Service for any unlawful purpose, or in a way that infringes the rights of others;
• scrape, reverse engineer, or interfere with the normal operation of the Service;
• upload content you do not have the right to share, or that is defamatory, fraudulent, or unlawful; or
• circumvent rate limits, security controls, access controls, or moderation decisions.

5. Marketplace terms

Marketplace lets you create listings and communicate with other Horsemen about them. Hisani is a listing and communication venue only: we are not a party to, do not facilitate, and do not process payment for any transaction between users, and we do not verify a listing's accuracy, a horse's health, or a counterparty's identity or authority to sell.

You are solely responsible for verifying the other party, the animal, and compliance with any applicable racing-authority, ownership, export, or import requirements before completing a transaction arranged through Marketplace. We may moderate, remove, or restrict listings and act on reports to protect the Service and its users.

6. Your content

You retain ownership of content you upload, including Marketplace listing photographs and documents. By uploading content, you grant Hisani a non-exclusive, worldwide licence to host, store, process, and display that content only as needed to provide the Service, including displaying listing content and making private conversation content available to its participants.

You represent that you have the rights and permissions necessary to upload the content you submit and that doing so does not infringe a third party's rights.

7. AI-generated draft data

Marketplace and My Horses may use an AI model to suggest structured horse data from a passport, name-plate, or similar document or photograph you choose to submit. The output is an unverified, editable draft only. We do not warrant that it is accurate or complete, and you are responsible for reviewing it before saving a horse, using it in a listing, or relying on it for any other purpose.

8. Suspension and termination

We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or to protect the security or integrity of the Service or other users. Where practical, we will provide notice of the reason for suspension or termination.

You may close your account from Account settings where that function is available. Section "Data retention" of our Privacy Policy describes how information may be handled afterward.

9. Intellectual property

The Hisani name, logo, and platform, excluding your content, are owned by Hisani or its licensors and are protected by applicable intellectual-property laws. Nothing in these Terms grants you a right to use our trademarks or branding without prior written consent.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

The Service is not a substitute for professional veterinary, financial, racing-regulatory, or legal advice. Information shown by the Service, including racing data, listings, calculations, and AI-generated drafts, should be independently verified before you rely on it for a consequential decision.

11. Limitation of liability

To the fullest extent permitted by applicable law, Hisani will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the amount you paid us, if any, for the Service in the twelve months before the claim arose.

Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold Hisani harmless from claims, losses, and expenses, including reasonable legal fees, arising from your breach of these Terms, your content, or your violation of any law or the rights of a third party.

13. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of the United Arab Emirates.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as an in-product notice or an update to the effective date, before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
